ZusammenfassungDie Beschäftigung mit der ethischen Dimension des ärztlichen Handelns beruht auf der freiwilligen Einsicht in deren Notwendigkeit. Es stellte sich die Frage, ob die Anwesenheit von Studierenden, die nur durch den Zwang des Stundenplans Ethikseminare besuchen, die Qualität der Veranstaltungen messbar negativ beeinflusst. In einer über 2 Jahre umfassenden Umfrage zu Lernzielen, Unterrichtsatmosphäre, Moderation und Fächerwichtigkeiten wurden die Ethikseminare an der Universität Ulm evaluiert. Hierzu bekamen wir Fragebögen von 192 freiwillig Teilnehmenden des Jahrgangs 2001/2002 und von 293 Pflichtteilnehmern des Jahrgangs (...) 2002/2003 zurück. Überraschenderweise gab es bei keiner relevanten Frage oder Bewertung einen statistisch signifikanten Unterschied zwischen freiwilligen und Pflichtteilnehmern. Zum Teil deutliche Unterschiede zeigten sich zwischen männlichen und weiblichen Studierenden. Diese Unterschiede müssen aufgrund ihrer didaktischen und konzeptionellen Bedeutung weiterverfolgt werden. Das Umfrageergebnis lässt hoffen, dass das Unterrichtskonzept der fallorientierten Kleingruppenseminare die Lernziele bei allen Studierenden verwirklichen kann. (shrink)

Patientenselbstbestimmung und Patientenverfügungen haben zunehmende Bedeutung und Beachtung erfahren. In der vorliegenden qualitativen Studie wurden 15 Patientinnen und Patienten mit amyotropher Lateralsklerose —einer unheilbaren, chronisch-degenerativen Erkrankung mit vorhersehbarer Symptomatik—interviewt, um zu erfahren, welche Werte und Kriterien sie bei prospektiven Entscheidungen am Lebensende und bei der Abfassung von PV zugrunde legen. Die Auswertung erfolgte nach der Methode der „grounded theory“. Die befragten Patientinnen und Patienten befürworteten einen Verzicht auf lebenserhaltende Behandlungen, wenn sie keine hinreichenden Lebensmöglichkeiten mehr sahen, d. h. wenn sie (...) die aktuelle Lebensqualität für unzureichend erachteten und die Chance auf Besserung als gering einschätzten. Dem Patientenwillen sprachen sie bei der Entscheidungsfindung ein Vetorecht zu. Patientenverfügungen fassten sie erst ab, als sie keine Hoffnung mehr auf Besserung ihrer Erkrankung hatten. Sie verstanden diese als Instrumente zur vorsorglichen Erklärung ihres Wunsches, auf lebensverlängernde Maßnahmen zu verzichten, wenn die LM inakzeptabel geworden sind. Damit wollten sie sich gegenüber dem Arzt absichern, den sie in der Rolle eines Anwalts des Lebens sahen und mit dem sie daher ihre Behandlungswünsche nicht besprochen haben. Trotz vorhersehbarer Symptomatik legten sie in ihren PV keine spezifischen Behandlungswünsche nieder, sondern verwendeten allgemeine Formularmuster ohne konkreten Bezug zu ihrer Erkrankung. Daher bestehen auch bei dieser Patientengruppe Zweifel, ob die PV in einer konkreten Behandlungssituation hilfreich sind. (shrink)

Zwischen Medizinethik und Behindertenbewegung besteht Uneinigkeit darüber, ob von einer Diskriminierung von behinderten Menschen durch biomedizinische Verfahren, wie der Pränatal- und der Präimplantationsdiagnostik, gesprochen werden kann. Dieser Konflikt beruht u. a. darauf, dass sich gesellschaftspolitische und ethische Argumente oft auf unterschiedlichen Ebenen bewegen. Während in der Ethik danach gefragt wird, ob durch die genannten Verfahren unmittelbar individuelle Rechte von Menschen mit Behinderungen verletzt werden, scheint es der Behindertenbewegung um die Verletzung des kollektiven Anspruches auf kulturelle Anerkennung zu gehen. Mit der (...) Unterscheidung verschiedener Anerkennungsverhältnisse in zwischenmenschlichen Beziehungen beabsichtigt der Beitrag, einen Rahmen für das Verständnis der Anliegen der Behindertenbewegung bereitzustellen. Daran anschließend wird eine Ethikkonzeption skizziert, die geeignet ist, die Argumente der Behindertenbewegung für eine konstruktive ethische Diskussion fruchtbar zu machen. (shrink)

This paper offers a few elements of an answer to the question to what extent drug patents can be morally justified. Justifications based on natural rights, distributive justice and utilitarian arguments are discussed and criticized. The author recognizes the potential of the patents to benefit society but argues that the system is currently evolving in the wrong direction, particularly in the field of drugs. More than a third of the world’s population has no access to essential drugs. The working of (...) the patent system is an important determinant of access to drugs. This paper argues that drug patents are not easily justified and that the ‘architecture’ of the patent system should be rethought in view of its mission of benefiting society. (shrink)

ZusammenfassungDer heutige Arbeitsalltag im medizinischen Betrieb ist durch verschiedene Belastungsfaktoren gekennzeichnet: 1) die Tempobeschleunigung und die Komplexitätssteigerung der medizinischen Entwicklung allgemein sowie 2) eine zunehmende moralische Verunsicherung des Personals in Bezug auf das Verhältnis von Möglichkeiten und Notwendigkeiten bestimmter therapeutischer Verfahren. Die in diesem Aufsatz vorgelegten Beobachtungen, die aus einem Projekt am Lehrstuhl für Ethik der Georg-August-Universität Göttingen resultieren, machen noch einen weiteren Punkt geltend, so dass 3) bereits die unterschiedliche Einschätzung rein sachlicher Fragen zu einem Dissens führen kann, der (...) als moralischer empfunden wird. Aus diesen drei Momenten erwächst ein allgemeiner Bedarf an ethischer Handlungsorientierung. Allerdings ist die Entlastung, die durch ethische Kommunikation, beispielsweise in klinischen Ethik-Komitees, erreicht wird, anderer Art als zunächst in der Regel erwartet. Denn die Leistung liegt nicht so sehr in der Lösung von Problemen als vielmehr in deren Beschreibung. (shrink)

İnsanın özgür iradesinin ispatı problemine yönelik çözüm denemelerinden biri Tanrı’nın kendisini gönüllü olarak sınırlaması anlamına gelen ilahi kendini sınırlama (divine self-limitation) yaklaşımıdır. Yahudi ve Hıristiyan teolojilerinde görülen bu perspektifle modern dönemde Süreç ve Kuantum felsefelerinde karşılaşılır. Bu çalışmada ilgili düşünce biçimi, Mu‘tezilî bilincin düşünce biçimiyle kıyaslanmıştır. Öncelikle Tanrı’nın kendini sınırlamasının imkânı, sınır teorisi varsayımıyla sorgulanmıştır. Buna göre ‘sınır’ evrene ve insana ‘yasa’ olarak içkindir. Evren de insan da fiziksel, kimyasal, biyolojik vd. yasalara/sınırlara tâbidir. Bu yasaların yaratıcısı olarak Tanrı da sorumluluğun (...) kaynağı akıl da insanı sınırlar ve sınır demek kavram, anlam, amaç, sistem ve düzen/kozmos demektir. Bu düzenin toplumsal hali ise zaman ve mekân ile sınırlı insanın teklif sahibi kılınarak eylemlerinin de sınırlandırılmasıdır. Peki, akla sınırlama fonksiyonu veren Tanrı’nın da kendi iradesini, ilmindeki tasarımının bir sonucu olarak sınırladığı varsayılabilir mi? Yahudi teolojisinde bu sınırlama, onların inançlarıyla ilişkili yaşadıkları ıstıraplara karşı Tanrı’nın müdahale etmemesinin bir nedeni olarak görülmekle beraber sınırlı âlemlerin var olabilmesi için Tanrı’nın sonsuz ışığını daraltması ve geri çekilmesi olarak da anlaşılmıştır. Hıristiyan teolojisinde ise sonsuzluğun evreni yaratmasının keyfiyeti, Tanrı’nın Mesih ile enkarnasyonu, kötülük ve özgür irade problemlerini çözmek için bu teoriye başvurulmuştur. Tanrı’nın, vahiy aracılığıyla bildirdiği teklif, aynı zamanda insana akıllı, sorumlu, dolayısıyla özgür olduğunu da hatırlatmaktadır. Muhammed İkbal (öl. 1928) bu özgürlüğün insana ilahi kendini sınırlama teorisiyle verilebileceği kanaatindedir. Bu görüşle Mu‘tezilî bilincin Tanrı tasavvurunda sezilen sınırın birlikte düşünülmesi mümkün müdür? Zira tekliften doğan özgürlüğün gereği, Mu‘tezile’ye Tanrı’nın iradesinin ezeli olmadığını, tercihlerinin yaratıcısının insanın kendisi olduğunu düşündürmüştür. Yine tanrısal adaletin bir gereği olarak, insana kudretin fiilden önce verilmesi, nübüvvet ile va‘d ve vaidin gerçekleşmesi gibi teklife dair meseleler Tanrı hakkında zorunlu kabul edilmiştir. Bu bilinçte aklın sınırlama fonksiyonu Tanrı’ya taşınmış görünür. Tanrı insanın eylemlerinde etkin değildir, kötülüğü de yaratmaz. Hatta bazı isimlere göre kötülüğe güç dahi yetiremez. Tanrı’nın malumatının ve makduratının da bir sınırı vardır. Mu‘tezile’deki bu sınırlı Tanrı tasavvuru, söz konusu ‘özgür irade’ olduğunda ilgili teoriyle yeniden ifade edilirse, adil ve hakim olan Tanrı’nın, ilmindeki bilinçli/akıl sahibi/sorumlu/özgür insan tasarımının gerektirmesiyle gönüllü olarak kendi özgürlüğünü sınırladığı söylenebilecektir. Bu söylem, varoluşsal amaçlılık anlamında insanın neden özgür olduğunun değil, Tanrı’nın vahyettiğine inanılan bir evrende nasıl özgür olabildiğinin muhtemel cevaplarından biridir. (shrink)

Sie beleuchten künstlerische, kulturelle und soziale Praktiken und Ordnungen als Aushandlungsort komplexer Bedeutungs- und Beziehungsgefüge.

Die Einführung der kostenkalkulierten und landesweit einheitlich bepreisten DRGs hat die Möglichkeiten gewinnorientierter Krankenhausträger, ehemals kommunale, defizitäre Krankenhäuser in die Gewinnzone zu führen, erschwert. Diese reagieren darauf mit dem Einsatz bisher nicht gekannter Werkzeuge wie beispielsweise der Steuerung von Patientenströmen, Anreizsystemen, Gründung von Privatkliniken sowie erlösorientierten Therapien und Abrechnungen. Mittlerweile bedienen sich auch andere Trägergruppen dieser Instrumente, so dass sich die Frage stellt, ob angesichts der Wettbewerbssituation nicht gewinnorientierte Träger eines besonderen wirtschaftlichen Schutzes bedürfen, damit die bisher im Krankenhaus gültigen (...) ethischen Prinzipien auch weiterhin Anwendung finden können. This article investigates a multiparty interaction in an accounting office by applying a multimodal approach to discourse. This approach allows the incorporation of all relevant communicative modes and is based on the following three notions: 1) the notion of mediated action; 2) the notion of modal density; and 3) the notion of a foreground– background continuum of attention/awareness. The article illustrates that a social actor in a multiparty interaction simultaneously co-constructs several higher-level actions with the various participants on different levels (...) of their attention/awareness. On a theoretical level, the article argues that traditional approaches to discourse analysis, with their unconditional focus on language as the primary mode, misconstrue the multiple higher-level actions that a social actor is engaged in simultaneously as dyadic or triadic interactions in quick succession. Background: An effectiveness assessment on ASCT in locally advanced and metastatic breast cancer identified serious ethical issues associated with this intervention. Our objective was to systematically review these aspects by means of a literature analysis. Methods: We chose the reflexive Socratic approach as the review method using Hofmann's question list, conducted a comprehensive literature search in biomedical, psychological and ethics bibliographic databases and screened the resulting hits in a 2-step selection process. Relevant arguments were assembled from the included articles, and (...) were assessed and assigned to the question list. Hofmann's questions were addressed by synthesizing these arguments. Results: Of the identified 879 documents 102 included arguments related to one or more questions from Hofmann's question list. The most important ethical issues were the implementation of ASCT in clinical practice on the basis of phase-II trials in the 1990s and the publication of falsified data in the first randomized controlled trials (Bezwoda fraud), which caused significant negative effects on recruiting patients for further clinical trials and the doctor-patient relationship. Recent meta-analyses report a marginal effect in prolonging disease-free survival, accompanied by severe harms, including death. ASCT in breast cancer remains a stigmatized technology. Reported health-related-quality-of-life data are often at high risk of bias in favor of the survivors. Furthermore little attention has been paid to those patients who were dying. Conclusions: The questions were addressed in different degrees of completeness. All arguments were assignable to the questions. The central ethical dimensions of ASCT could be discussed by reviewing the published literature. (shrink)

Critics across the political spectrum have worried that ordinary uses of words like 'racist', 'sexist', and 'homophobic' are becoming conceptually inflated, meaning that these expressions are getting used so widely that they lose their nuance and, thereby, their moral force. However, the charge of conceptual inflation, as well as responses to it, are standardly made without any systematic investigation of how 'racist' and other expressions condemning oppression are actually used in ordinary language. Once we examine large linguistic corpora to see (...) how these expressions are actually used, we find that English speakers have a rich linguistic repertoire for qualifying the degree to which and dimensions along which something is racist, sexist, homophobic, and so on. These facts about ordinary usage undermine the charge of conceptual inflation. Without awareness of facts about ordinary usage, theorists risk making linguistic prescriptions that are unnecessary or counterproductive. (shrink)

We investigate claims about the frequency of "know" made by philosophers. Our investigation has several overlapping aims. First, we aim to show what is required to confirm or disconfirm philosophers’ claims about the comparative frequency of different uses of philosophically interesting expressions. Second, we aim to show how using linguistic corpora as tools for investigating meaning is a productive methodology, in the sense that it yields discoveries about the use of language that philosophers would have overlooked if they remained in (...) their "armchairs of an afternoon", to use J.L. Austin’s phrase. Third, we discuss facts about the meaning of "know" that so far have been ignored in philosophy, with the aim of reorienting discussions of the relevance of ordinary language for philosophical theorizing. This paper sets out the felicity conditions for metalinguistic proposals, a type of directive illocutionary act. It discusses the relevance of metalinguistic proposals and other metalinguistic directives for understanding both small- and large-scale linguistic engineering projects, essentially contested concepts, metalinguistic provocations, and the methodology of ordinary language philosophy. Metalinguistic proposals are compared with other types of linguistic interventions, including metalinguistic negotiation, conceptual engineering, lexical warfare, and ameliorative projects.

Stanley Cavell’s account of aesthetic judgment has two components. The first is a feeling: the judge has to see, hear, ‘dig’ something in the object being judged, there has to be an ‘emotion’ that the judge feels and expresses. The second is the ‘discipline of accounting for [the judgment]’, a readiness to argue for one’s aesthetic judgment in the face of disagreement. The discipline of accounting for one’s aesthetic judgments involves what Nick Riggle has called a norm of convergence: the (...) judge aims to get one’s audience to taste see or hear what the judge tastes or sees or hears in the object being judged. Because of the unmistakable difficulty in reaching agreement in aesthetic judgment, Riggle has denied that aesthetic judgment requires a convergence norm and has proposed instead that it requires ‘a kind of harmony of individuality’ (which Riggle calls ‘vibing’). We argue that Cavell offers a version of the convergence norm that is distinct from those that Riggle criticizes, namely Kant’s demand for agreement and Andy Egan’s presupposition of similarity in dispositions in ‘non-defective’ aesthetic conversations. Cavell’s version of the convergence norm is ‘the hope of agreement’. One can hope that one’s audience will agree with one’s aesthetic judgments even when one isn’t in a position to demand agreement or to presuppose similarity in the dispositions that would make agreement more likely. Cavell’s distinct convergence norm avoids Riggle’s criticisms and contributes to a richer account of what’s going on when we disagree about aesthetic matters. (shrink)

This paper defends a challenge, inspired by arguments drawn from contemporary ordinary language philosophy and grounded in experimental data, to certain forms of standard philosophical practice. The challenge is inspired by contemporary philosophers who describe themselves as practicing “ordinary language philosophy”. Contemporary ordinary language philosophy can be divided into constructive and critical approaches. The critical approach to contemporary ordinary language philosophy has been forcefully developed by Avner Baz, who attempts to show that a substantial chunk of contemporary philosophy is fundamentally (...) misguided. I describe Baz’s project and argue that while there is reason to be skeptical of its radical conclusion, it conveys an important truth about discontinuities between ordinary uses of philosophically significant expressions (“know”, e.g.) and their use in philosophical thought experiments. I discuss some evidence from experimental psychology and behavioral economics indicating that there is a risk of overlooking important aspects of meaning or misinterpreting experimental results by focusing only on abstract experimental scenarios, rather than employing more diverse and more ecologically valid experimental designs. I conclude by presenting a revised version of the critical argument from ordinary language. (shrink)

This paper concerns the central method of generating evidence in support of contextualist theories, what we call context shifting experiments. We begin by explaining the standard design of context shifting experiments, which are used in both quantitative surveys and more traditional thought experiments to show how context affects the content of natural language expressions. We discuss some recent experimental studies that have tried and failed to find evidence that confirms contextualist predictions about the results of context shifting experiments, and consider (...) the criticisms of those studies made by DeRose (forthcoming). We show that DeRose's criticisms are incomplete, and we argue that the design of context shifting experiments he proposes is itself subject to some of the same problems as the studies he criticizes. We propose a refined approach to the design of context shifting experiments that addresses these problems and which allows us to to investigate the effect of context on both positive and negative sentences. This aspect of our design allows us to control for several forms of bias, including a particular form of "truth bias" that favors positive over negative sentences. We then deploy our improved design in an experiment that tests a large number of scenarios involving different types of expressions of interest to contextualists, including "know" and color adjectives like "green". Our experiment (i) reveals an effect of changing contexts on the evaluation of uses of the sentences that we examined, thereby overturning the absence of results reported in previous experimental studies (so-called null results) and (ii) reveals previously unnoticed distinctions between the strength of the contextual effects we observed for scenarios involving knowledge ascriptions and for scenarios concerning color and other miscellaneous scenarios. Existing theories of the meaning of color adjectives attempt to answer that question using informal ("armchair") judgments. The informal judgments of theorists conflict: it has been proposed that color adjectives are absolute with standards anchored at the minimum degree on the scale, that they are absolute but have near-midpoint standards, and that they are relative. In this paper we report two experiments, one based on entailment patterns and one based (...) on presupposition accommodation, that investigate the meaning of scalar adjectives. We find evidence confirming the existence of subgroups of the population who operate with different standards for color adjectives. The evidence of interpersonal variation in where standards are located on the relevant scale and how those standards can be adjusted indicates that the existing theories of the meaning of color adjectives are at best only partially correct. We also find evidence that paradigmatic relative adjectives ("tall", "wide") behave in ways that are not predicted by the standard theory of scalar adjectives. We discuss several different possible explanations for this unexpected behavior. We conclude by discussing the relevance of our findings for philosophical debates about the nature and extent of semantically encoded context sensitivity in which color adjectives have played a key role. There is a widespread assumption that ordinary language philosophy was killed off sometime in the 1960s or 70s by a combination of Gricean pragmatics and the rapid development of systematic semantic theory. Contrary to that widespread assumption, however, contemporary versions of ordinary language philosophy are alive and flourishing, but going by various aliases—in particular (some versions of) "contextualism" and (some versions of) "experimental philosophy". And a growing group of contemporary philosophers are explicitly embracing the methods as well as the title (...) of ordinary language philosophy and arguing that it has been unfairly maligned and was never decisively refuted. In this overview, I will outline the main projects and arguments employed by contemporary ordinary language philosophers, and make the case that updated versions of the arguments made by ordinary language philosophers in the middle of the twentieth century are attracting renewed attention.
